Intellectual property
The copyright and all rights to the artwork remain the sole property of Marjo Lebbe at all times, including after purchase. This applies to originals, commissions, prints and any current or future reproductions of any kind. The purchase of any item does not grant the customer permission to mint the work as an NFT, to print and distribute it in any form, or to reproduce it in any way for commercial or other purposes. Collectors may not reproduce the artwork without express written permission from the artist.
Sharing photos of your purchased piece on social media is always welcome and does not breach this clause. When you do, we kindly ask that you tag @marjolebbe so the work can be credited to the artist.
Liability
We are not liable for goods once they are in the possession of the collector. We are not obliged to refund, exchange, replace or otherwise compensate for damage to products that have been mishandled by the customer, for example smudged fingerprints on a white border, torn prints or damaged works. As guaranteed under applicable consumer law, compensation is due where products arrive damaged due to the postal service, or where faulty merchandise has been dispatched. Every piece is inspected several times before it clears quality control, and only pristine items are packaged for you. Please read each product description thoroughly before purchasing; we cannot compensate customers who did not read the information provided prior to purchase. All prints include the borders shown in the listed final size.
Restoration & repairs
The good news is that almost anything can be restored. If your piece is damaged after it reaches you, we strongly recommend contacting the artist first and having any repair carried out by Marjo herself, not by a local framer. The artist knows exactly how each work is constructed and what is needed to restore it correctly.
Whether the cost is borne by the collector depends on the nature of the damage. Damage caused by the collector, or by exposure to moisture or heat, is payable by the collector. Manufacturing faults, such as warping of the frame or the paint lifting or flaking, are covered under warranty. This has never happened to date, but anything is possible. In all cases, please get in touch so we can assess together whether the damage falls under warranty or not.
Colour accuracy
We make every reasonable effort to ensure artwork photography accurately represents the colours and appearance of each piece. Colours may nevertheless vary between devices due to differences in monitor, screen and display calibration. Such variation does not constitute a fault or defect. If colour accuracy is important to you, we encourage you to view the product images across several devices before purchasing.
Duties & taxes
The studio is based in Belgium (European Union). For deliveries within the EU, prices are inclusive of any applicable VAT. For deliveries outside the EU, any import duties, taxes or similar charges are not included in the checkout total and are determined by the customs agency in the destination country. The customs agency will notify the recipient by mail, phone or email to settle these charges so the shipment can continue to its destination. It is the customer's responsibility to pay any duties, VAT or similar charges. If you refuse to pay these amounts your parcel will be returned to us; provided the product is in its original condition, we will refund the cost of your purchase minus the original shipping cost. Items are declared at their purchase value for export, and under no circumstances will documents be falsified at your request.
Shipping & Delivery
Originals are delivered within two weeks. If you need your piece sooner, a rush delivery within one week is possible, please note this in the comments when placing your order.
Prints are delivered within three weeks. Each print is made to order after your purchase, and I then need additional time to hand-embellish every piece before it is dispatched.
While I endeavour to dispatch every order as promptly as possible, processing times may occasionally be extended during periods of exceptionally high demand, for example after social media exposure, major sales, product launches or holiday periods. I appreciate your patience and understanding should such delays occur.
Customers are responsible for ensuring that all shipping information provided at checkout is complete, accurate and current. Requests to amend a shipping address must be submitted within twenty-four (24) hours of purchase. We will make reasonable efforts to accommodate address changes within this window, but changes cannot be guaranteed once order processing has begun.
Once an order has been dispatched we are unable to alter the delivery address and accept no responsibility for parcels delayed, lost, misdirected, returned or otherwise undelivered due to incorrect or incomplete shipping information supplied by the customer.
Where an order is returned to us due to an incorrect, incomplete or undeliverable address, the customer is responsible for any additional shipping cost incurred to resend the parcel. If the customer chooses to cancel the order after it has been returned, any refund issued will exclude shipping and handling costs already incurred.
Returns & Refunds
EU right of withdrawal (cooling-off period)
In accordance with EU consumer protection legislation, customers residing within the European Union who buy online may be entitled to cancel their purchase within fourteen (14) days of receiving the goods, without giving a reason. Where applicable, you must notify the studio of your intention to withdraw within this 14-day period, and returned goods must be sent back promptly and in their original condition.
The customer is solely responsible for all costs associated with returning goods to the studio, including shipping, postage, insurance, customs duties, taxes and any related fees. The studio does not reimburse return shipping expenses except where the item is faulty, damaged in transit, incorrectly supplied, or where required by law.
Pursuant to Article 16 of the Consumer Rights Directive, the right of withdrawal does not apply to commissioned works, bespoke goods, personalised items or other products exempt from withdrawal rights under applicable law.
The customer is liable for any diminished value of the goods resulting from handling beyond what is reasonably necessary to establish their nature, characteristics and functioning. Due to the delicate nature of fine-art products, returned artworks and prints must be received in their original, saleable condition. Any evidence of damage, excessive handling, wear, creasing, folded corners, tears, scratches, staining, mounting, framing or alteration may result in the return being declined, or an appropriate deduction being made from the refund where permitted by law.
How to return a piece
It is very important that any returned work is sent back in its original packaging. The packaging is specifically designed to protect the artwork in transit, and we cannot accept returns that are not properly packaged in their original materials.
To make sure the shipment is correctly insured, I create the return label myself and send it to you, please do not arrange your own carrier. The cost of return shipping is borne by the collector. Once you let me know you wish to return a piece, I will arrange the insured return ticket for you.
If something is wrong with your order
If there is an issue with your order we will work with you in good faith to resolve it as promptly as possible. If an item arrives damaged, defective, incorrect or otherwise not as ordered, please contact the studio with relevant photographs and details so an appropriate resolution can be arranged. In these cases, where an item was delivered damaged, defective, incorrect or otherwise not as ordered, the cost of returning the piece is borne by us, not the collector. To help verify and process replacement requests, we may ask for a photograph of the packing documentation supplied with your order together with photos of all contents received. Where a return is accepted, refunds are processed in line with applicable consumer law following receipt and inspection of the returned goods.
Privacy Policy
Your privacy matters. This policy explains what personal information we collect, why we collect it and how we handle it, in line with the EU General Data Protection Regulation (GDPR).
What we collect
When you place an order or contact the studio we may collect your name, email address, postal address, phone number and the details of your order. Payment information is processed securely by our payment providers; we do not store your full card details.
How we use your information
We use your information only to process and deliver your order, to respond to enquiries, to arrange commissions, and, where you have given consent, to send you occasional updates about new work and exhibitions. You can unsubscribe from any newsletter at any time using the link in the email.
Sharing
We share your information only with the service providers needed to fulfil your order, such as payment processors and shipping carriers, and only to the extent necessary. We never sell your personal information to third parties.
Your rights
Under the GDPR you have the right to access, correct or delete the personal information we hold about you, and to object to or restrict certain processing. To exercise any of these rights, or if you have questions about this policy, please contact the studio by email.
Retention
We keep your information only as long as necessary to fulfil the purposes described above and to comply with our legal and accounting obligations.
